1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User" or "you") and Mawajeeb ("we," "us," or "our"). By accessing or using the Mawajeeb app, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, Delivery Policy, and Cancellation Policy.

2. Use of the App

  • Eligibility: You must be at least 18 years old to use the Mawajeeb app. By using the app, you represent that you are of legal age and capable of entering into this agreement.

  • Account Registration: To use the app, you must create an account by providing accurate and complete information, including your name, phone number, email address, and delivery address. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

  • Prohibited Activities: You agree not to use the app for any unlawful purpose, to resell food purchased through the app, or to engage in any activity that disrupts or interferes with the app's functionality.

3. Ordering and Payment

  • Order Placement: When you place an order through Mawajeeb, you authorize us to act as your agent in placing the order with the selected restaurant. The restaurant is solely responsible for preparing and delivering the food.

  • Payment: You agree to pay for all orders placed through the app, including any applicable delivery fees, taxes, and service charges. Payments can be made via credit/debit card, net banking, or other methods available on the app. All payments are processed securely through our third-party payment gateway.

  • Pricing: Menu prices are set by the restaurants and may vary. Mawajeeb is not responsible for any discrepancies in pricing or availability of menu items.

4. Delivery

  • Delivery Services: Mawajeeb facilitates the delivery of your order through third-party delivery partners. We do not guarantee delivery times, as they may be affected by factors beyond our control, such as traffic or weather conditions.

  • Delivery Fees: Delivery fees may apply and will be displayed at the time of checkout. These fees are determined by the distance, demand, and other factors.

  • Accuracy of Information: You are responsible for providing accurate delivery information. If incorrect information leads to delivery delays or failures, Mawajeeb will not be held responsible.

5. Cancellations and Refunds

  • Order Cancellation: You may cancel an order before it is confirmed by the restaurant. Once confirmed, cancellations may be subject to a cancellation fee, as outlined in our Cancellation Policy.

  • Refunds: Refunds are issued in accordance with our Cancellation Policy. If you are eligible for a refund, it will be processed to the original payment method or as app credit, depending on the circumstances.

6. User Responsibilities

  • Accurate Information: You must provide accurate and up-to-date information when placing orders. Failure to do so may result in order cancellations or delivery failures.

  • Conduct: You agree to use the app in a respectful manner and not to engage in any behavior that could harm the reputation of Mawajeeb or its restaurant partners.

7. Limitation of Liability

Mawajeeb is a platform that connects users with restaurants and delivery services. We are not responsible for:

  • The quality, safety, or legality of the food provided by restaurants.

  • Any delays, damages, or losses during delivery.

  • Any disputes between users and restaurants or delivery partners.

To the fullest extent permitted by law, Mawajeeb shall not be liable for any indirect, incidental, or consequential damages arising from your use of the app.

8. Intellectual Property

All content on the Mawajeeb app, including trademarks, logos, and designs, is the property of Mawajeeb or its licensors. You may not use, reproduce, or distribute any content without prior written permission.

9. Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in any fraudulent or unlawful activities.

10. Changes to Terms

We may update these Terms from time to time. Any changes will be posted on the app, and your continued use of the app constitutes acceptance of the updated Terms.
